In a move that has stirred both support and criticism, President Joe Biden granted a full pardon to his son, Hunter Biden, on Sunday evening, effectively clearing him of potential prison sentences for federal felony charges related to gun and tax offenses. This action marks a significant reversal of the president’s earlier promises not to use his presidential powers to aid his family in legal matters.
Hunter Biden, who faced charges in Delaware and California, had been convicted in June for purchasing a gun in 2018 while lying on a federal form regarding his drug use. He had also agreed to plead guilty to misdemeanor tax charges after facing accusations of failing to pay over $1.4 million in taxes. However, the legal proceedings and media scrutiny surrounding his cases had raised concerns of political influence, with Hunter Biden’s legal team describing the investigations as politically motivated.
In his statement, President Biden expressed his belief in the justice system but also noted that “raw politics” had tainted the legal process. “I believe in the justice system, but as I have wrestled with this, I also believe raw politics has infected this process and it led to a miscarriage of justice,” he said, explaining the reasoning behind his decision.
The pardon, which extends to any offenses Hunter Biden may have committed from January 1, 2014, through December 1, 2024, comes just weeks before Hunter was scheduled for sentencing. The decision is seen as an effort to end a long-running legal saga that began with his public disclosure of a federal investigation in 2020.
The president had previously ruled out the possibility of pardoning his son, notably stating in June that he would respect the legal process and would not intervene. “I abide by the jury decision. I will do that and I will not pardon him,” Biden had said at the time. Similarly, White House press secretary Karine Jean-Pierre reiterated the same stance in November.
Despite these statements, the pardon has sparked political controversy, with critics accusing the president of undermining his own pledge to uphold the rule of law. Republican lawmakers, in particular, have been vocal about their disapproval, with Rep. James Comer accusing the Bidens of evading accountability.
Hunter Biden has acknowledged his past mistakes, especially regarding his struggles with drug addiction, and expressed relief over the pardon. “I have admitted and taken responsibility for my mistakes during the darkest days of my addiction – mistakes that have been exploited to publicly humiliate and shame me and my family for political sport,” he stated, vowing to use his experience to help others facing similar challenges.
The legal team for Hunter Biden has filed motions in both Los Angeles and Delaware to dismiss the charges against him in light of the presidential pardon.
The pardon follows a broader pattern seen in U.S. presidencies, with past presidents, including Donald Trump, using their powers to assist family members and close associates.
As Hunter Biden begins a new chapter following the legal resolution, the political fallout surrounding his father’s decision is likely to continue as the 2024 election season heats up.
